Terms of Service

These Terms of Service (these “Terms”) govern your access to and use of the website www.chromeworld.store (the “Website”), operated on behalf of Chrome World (“Company,” “we,” “us,” or “our”), together with any online content, tools, features, checkout flows, and functionality offered on or through the Website (collectively, the “Services”).
These Terms apply to all visits to and use of the Services, including any purchases you make through the Services. Please read these Terms carefully, as they contain important information regarding your legal rights and obligations. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
For purposes of these Terms, “you” and “your” mean the individual or entity using the Services. If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms and that you agree to these Terms on its behalf.
Please note that Section 9 contains an arbitration clause and class action waiver. By agreeing to these Terms, you: (a) agree to resolve disputes with us only through binding individual arbitration (rather than in court before a judge or jury), and (b) waive any right to participate in class actions, class arbitrations, or representative actions. You may have a right to opt out of arbitration as explained in Section 9.

1. WHO MAY USE THE SERVICES
You must be 13 years of age or older and reside in a jurisdiction where use of the Services is lawful to use the Services.
If you are under the age of majority in your jurisdiction but at least 13 years old, you may use the Services only if a parent or legal guardian accepts these Terms on your behalf before you access the Services. Children under 13 are not permitted to use the Services.
By using the Services, you represent and warrant that you meet these requirements and that all information you provide is truthful and accurate.
2. USER ACCOUNTS, SUBSCRIPTIONS AND FREE TRIALS
2.1. Creating and Safeguarding Your Account
To access certain features of the Services, you may be required to create an account (“Account”). You agree to provide accurate, current, and complete information for your Account and to update this information as necessary.
You are solely responsible for:
All activities that occur under your Account, and
Maintaining the confidentiality and security of your login credentials.
Chrome World is not responsible for any loss or damage resulting from your failure to safeguard your Account or password.
If you know or suspect that your Account or password has been compromised, you must promptly notify us at privacy@chromeworld.store.
3. ORDERS FOR PRODUCTS AND/OR SERVICES
3.1. Payment
The Services may permit you to purchase certain physical products or services (“Offerings”). You agree that all information you provide in connection with a purchase, including payment information, will be accurate, current, and complete, and that you are authorized to use the payment method you provide.
When you purchase Offerings, you:
Agree to pay the total amount due, including product price, shipping and handling (if any), and applicable taxes (the “Full Purchase Amount”); and
Authorize Chrome World or its payment processor to charge your payment method for the Full Purchase Amount.
Unless otherwise noted, all prices are listed in U.S. Dollars. All payments are subject to the payment terms in effect at the time of purchase. Orders will not be processed until payment is received in full. Any holds or fees imposed by your payment provider are your sole responsibility.
3.2. Promotional Codes
From time to time, we may issue promotional codes, referral codes, discount codes, coupons, or similar offers (“Promotional Codes”). Promotional Codes:
Must be used only in a lawful manner, for their intended audience and purpose;
May not be copied, sold, transferred, or made publicly available (for example, on coupon sites) unless expressly permitted by Chrome World;
May be modified, suspended, or canceled by Chrome World at any time without liability;
Are not redeemable for cash or other credits unless required by law; and
May be subject to additional terms which will be disclosed at the time of issuance.
3.3. Product Information
We aim to be as accurate as possible in our descriptions and presentation of Offerings. However, we do not guarantee that product descriptions, images, specifications, or other content on the Services are error-free, complete, current, or reliable.
Variations in device settings and displays may affect how products and colors appear to you. Any sizing or measurement information is approximate and provided for convenience only.
If an Offering you receive is not as described, your sole remedy is to return it in unused condition in accordance with our Return & Refund Policy.
3.4. Product Availability
The inclusion of any Offering on the Services at a particular time does not guarantee that it will be available at any given time. Products that appear available may become unavailable for a variety of reasons, including inventory changes or delays in updating the Services.
We reserve the right, without prior notice, to:
Limit the quantity of any Offering,
Discontinue any Offering, or
Impose conditions on the use of any Promotional Code or sale.
3.5. Changes and Pricing
Chrome World may, at any time and in its sole discretion, change prices, availability, descriptions, or specifications for any Offerings. We may correct any errors or inaccuracies, including pricing errors, even after you have placed an order.
If we correct a pricing error after you have been charged, we may:
Cancel the order and issue a full refund, or
Contact you with options regarding the corrected price.
All such changes are effective when posted on the Services or when otherwise communicated to you.
3.6. Order Acceptance; Shipment
Your receipt of an order confirmation does not constitute acceptance of your order by Chrome World, nor does it confirm an offer to sell. We reserve the right, at any time after receiving your order, to accept or decline your order for any reason, including suspicion of fraud, inventory issues, or problems with payment authorization.
If we cancel an order after you have been charged, we will refund the billed amount.
Title and risk of loss for physical products pass to you when we deliver the goods to the carrier. We may ship your order in multiple packages at no additional cost to you. While we may provide estimated delivery dates, we do not guarantee delivery by any specific date or time.
3.7. Returns, Refunds and Exchanges
Returns, refunds, and exchanges for Offerings purchased through the Services are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.
3.8. No Delivery to Children
In keeping with our policy of not collecting personal information from children under 13, users may not provide personal information for any person under 13 for shipping or any other purpose.
4. LOCATION OF OUR PRIVACY POLICY AND OTHER APPLICABLE POLICIES
4.1. Privacy Policy
Our Privacy Policy explains how we collect, use, share, and safeguard information in connection with the Services. By using the Services, you acknowledge that you have read and understood our Privacy Policy. The Privacy Policy is available on the Website.
4.2. Other Disclosures and Policies
Other supplemental policies and notices (such as shipping, returns, or regional legal disclosures) may apply to specific aspects of the Services and are also available on the Website. Those additional policies are incorporated into these Terms by reference.
5. RIGHTS WE GRANT YOU
5.1. License Grant
Subject to your compliance with these Terms, Chrome World grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your own non-commercial use, solely as permitted by these Terms and any other applicable policies.
We may suspend, modify, or discontinue the Services (in whole or in part) at any time without liability.
5.2. Restrictions on Your Use of the Services
Except as expressly permitted in these Terms or allowed by applicable law, you agree not to:
a) Copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any information or materials obtained from or through the Services;
b) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services;
c) Remove or alter any copyright, trademark, or other proprietary notices;
d) Use any automation tools (bots, scrapers, crawlers) to access or interact with the Services;
e) Use the Services for any commercial purpose not expressly authorized by Chrome World;
f) Interfere with or disrupt the operation or security of the Services or any networks connected to the Services;
g) Attempt to gain unauthorized access to any Accounts, systems, or networks;
h) Circumvent any technological measures or content protection systems used by the Services;
i) Introduce any virus, malware, or other harmful code; or
j) Use the Services in any manner that violates applicable law or these Terms.
6. OWNERSHIP AND CONTENT
6.1. Ownership of the Services
The Services (including their overall look and feel, design, text, graphics, logos, icons, images, video, audio, and software) are owned or licensed by Chrome World and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by Chrome World and its licensors.
6.2. Trademarks
All Chrome World names, logos, product names, and related marks are trademarks or service marks of Chrome World or its affiliates. Other names, logos, and brands appearing on the Services are the property of their respective owners. You may not use any such marks without the prior written permission of the relevant owner.
6.3. Feedback
We welcome your comments, suggestions, and feedback regarding the Services (“Feedback”). By submitting Feedback, you agree that Chrome World may use it freely and without restriction, and you assign to Chrome World all right, title, and interest in and to such Feedback without any compensation to you.
7. THIRD PARTY SERVICES AND MATERIALS
The Services may display or link to content, data, information, applications, or materials provided by third parties (“Third Party Materials”) and may direct you to third-party websites or services.
Chrome World does not control and is not responsible for Third Party Materials, including their accuracy, legality, or security. Your interactions with third parties are solely between you and the third party. We are not liable for any loss or damage arising from your use of or reliance on Third Party Materials or third-party services.
8. DISCLAIMERS, LIMITATIONS OF LIABILITY AND INDEMNIFICATION
8.1. Disclaimers
YOUR ACCESS TO AND USE OF THE SERVICES IS AT YOUR OWN RISK. THE SERVICES, INCLUDING ALL CONTENT AND OFFERINGS, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHROME WORLD AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS (COLLECTIVELY, THE “CHROME WORLD ENTITIES”) DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.
WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
8.2. Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE CHROME WORLD ENTITIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL LIABILITY OF THE CHROME WORLD ENTITIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED THE GREATER OF:
(a) ONE HUNDRED U.S. DOLLARS (US $100); OR
(b) THE AMOUNT YOU PAID TO CHROME WORLD IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
8.3. Indemnification
You agree to defend, indemnify, and hold harmless the Chrome World Entities from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use or misuse of the Services;
Your violation of these Terms;
Your violation of any law or the rights of any third party; or
Any content or information you submit through the Services.
9. ARBITRATION AND CLASS ACTION WAIVER
9.1. Informal Resolution First
Before initiating formal legal proceedings, you agree to first contact Chrome World and make a good-faith effort to resolve any dispute informally. You can contact us at privacy@chromeworld.store.
9.2. Arbitration Agreement and Class Action Waiver
If a dispute is not resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services (a “Claim”) will be resolved exclusively by binding individual arbitration, except as otherwise provided below.
Arbitration will be administered by JAMS under its applicable rules, using a single arbitrator, and conducted in English. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
You and Chrome World agree that:
All Claims must be brought in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding; and
The arbitrator may not consolidate Claims or preside over any form of class or representative proceeding.
By agreeing to these Terms, you and Chrome World each waive the right to a jury trial and to participate in a class action or class arbitration.
You may assert your claim in small claims court instead of arbitration if your claim qualifies and remains on an individual, non-class basis.
9.3. Costs of Arbitration
Payment of arbitration fees will be governed by the JAMS rules, except that Chrome World may pay all reasonable filing, administrative, and arbitrator fees for claims under a certain monetary threshold, unless the arbitrator determines that your claim is frivolous or brought for an improper purpose.
9.4. Opt-Out
You may opt out of this arbitration agreement by sending written notice of your decision to privacy@chromeworld.store within thirty (30) days of first accepting these Terms. If you opt out, Chrome World will also not be bound by this arbitration provision. Opting out will not affect the rest of these Terms.
10. ADDITIONAL PROVISIONS
10.1. Updating These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Revised” date at the top. If changes are material, we may provide additional notice (for example, by email or prominent notice on the Website). Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the changes.
10.2. Termination of License and Account
If you violate these Terms, all rights and licenses granted to you will automatically terminate. Chrome World may suspend, disable, or delete your Account and/or restrict access to the Services at any time, with or without notice, for any or no reason. Sections that by their nature should survive termination will remain in effect.
10.3. Injunctive Relief
You agree that Chrome World may seek injunctive or other equitable relief if you breach these Terms, in addition to any other remedies available at law or in equity, without the requirement to post a bond or prove actual damages.
10.4. California Residents
If you are a California resident, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or via their published contact details, to lodge a complaint or obtain further information about your rights.
10.5. Miscellaneous
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity of the remaining provisions. You may not assign these Terms or your rights or obligations hereunder without our prior written consent. Chrome World may freely assign these Terms.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, and subject to the arbitration provisions in Section 9. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
